P.IVA: 01164240283 C.F.: BTTMNL65E29G224U REA: VE-302632, Chamber of Commerce of Venice Rovigo PEC: bottaromanuel@pec.it The Site allows customers to order grocery and everyday products online, with pickup exclusively at the Market Bottaro store in Bibione (VE). By using the Site and placing an order, you fully accept these Terms and Conditions.
Market Bottaro offers an online grocery shopping service with in-store pickup (click & collect). No home delivery service is offered. Products ordered through the Site will be prepared by our staff and made available for pickup at the store during the time slot selected by the customer.
To place an order: 1. Browse the product catalogue and add the items you want to your cart. 2. Open your cart and review the contents of your order. 3. Proceed to checkout, select the pickup date and time slot. 4. Enter your contact details (name, email, phone). 5. Complete payment by credit or debit card. 6. You will receive an order confirmation by email with a QR code to show at pickup.
All prices on the Site are in Euro (EUR) and include applicable VAT. Payment is made in advance when the order is placed, through the secure Stripe payment system. We accept the main credit and debit cards. The price applied is the one shown on the Site at the time the order is confirmed.
Pickup takes place at the Market Bottaro store during the time slot selected at checkout. The customer must show the order confirmation or the QR code received by email. If the order is not collected on the scheduled day without prior notice, it may be cancelled and no refund is guaranteed for perishable products.
Order cancellation (commercial courtesy) The customer may request cancellation of the order and receive a full refund of the amount paid as long as the order is in the "New" status, that is before Market Bottaro's staff takes it into preparation. Once the order enters the "In preparation" status it can no longer be cancelled. To request cancellation, go to the "My orders" page and click the "Cancel order" button. Right of withdrawal (Italian Legislative Decree 21/2014) Since this is a sale with physical pickup in store (click & collect), the consumer's right of withdrawal - where applicable - runs from the date of handover of the goods at pickup. Exclusions from the right of withdrawal (art. 59 Italian Legislative Decree 21/2014): the right of withdrawal does not apply to the following products, which make up almost the entire Market Bottaro catalogue: - foods prepared to order or personalised by the customer (e.g. build-your-own panini) - art. 59 lett. c - fresh, perishable or quickly deteriorating food products (cold cuts, cheeses, fruit, vegetables, bread, dairy, etc.) - art. 59 lett. d - sealed food products which, once opened, are not suitable for return for reasons of hygiene protection - art. 59 lett. e For products not falling within the exclusions above (e.g. cleaning products, stationery, household products in their unopened packaging), the consumer may exercise the right of withdrawal within 14 days from the date of pickup, by writing to info@marketbottaro.it. The refund will be issued to the payment method used for the order within 14 days from the return of the intact goods. In the event of defective or non-conforming products, the customer always has the right to replacement or refund under the legal warranty of conformity.
Product availability is subject to change and cannot be guaranteed until the moment the order is prepared. If one or more products are unavailable, the customer will receive a refund of the amount corresponding to the unavailable products.
The minimum amount to place an order is €0.50.
The user undertakes to provide accurate and up-to-date contact information (name, email address, and phone number) when placing an order. Market Bottaro is not responsible for missed communications due to incorrect or incomplete data provided by the user.
Market Bottaro prepares and stores products with the care required by their nature. However, it assumes no liability for any indirect damages resulting from use of the Site or from delays in preparing orders due to force majeure events. Market Bottaro's maximum liability is limited to the amount of the order in question.
All products sold through the Site are covered by the 24-month legal warranty of conformity provided for by arts. 128 and following of the Italian Consumer Code (Legislative Decree 206/2005), for any lack of conformity existing at the time of handover at pickup. For perishable food products, the warranty is limited to the minimum durability date (TMC) or the expiration date shown on the packaging: any lack of conformity must be reported promptly and in any case before that date. In the event of a lack of conformity, the consumer is entitled, at their choice, to have conformity restored by replacement of the goods, or to a price reduction or termination of the contract, under the conditions and within the terms provided by law. These Terms and Conditions are governed by Italian law. For disputes involving a consumer, exclusive jurisdiction lies with the court of the consumer's place of residence or elective domicile, if located within the territory of the Italian State, pursuant to art. 66-bis of the Italian Consumer Code (Legislative Decree 206/2005). For disputes in which the customer is not acting as a consumer (e.g. parties holding a VAT number purchasing in the exercise of their professional activity), exclusive jurisdiction lies with the Court of Venice.
If you wish to file a complaint, you may contact us at any time at info@marketbottaro.it: we undertake to reply within 30 days. Under arts. 141 and following of the Italian Consumer Code (Italian Legislative Decree 206/2005), the consumer may use the alternative dispute resolution (ADR) procedures, by contacting the ADR bodies listed in the register kept by the Italian Ministry of Enterprises and Made in Italy. Art. 141-bis of the Italian Consumer Code grants the consumer the right to access such procedures on a voluntary basis. This does not in any way affect the consumer's right to bring proceedings before the competent court.
